Entity: My Scribe Now, a division of Annihilation LTD, and any of its members ("My Scribe Now," "we," "our," or "us")
By accessing or using the My Scribe Now website, mobile application, or transcription platform (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not access or use the Service. My Scribe Now may modify these Terms at any time, and updated versions will be posted online. Continued use constitutes acceptance.
My Scribe Now provides a secure digital platform enabling credentialed physicians and medical scribes to transcribe, review, and receive medical documentation. The Service is intended for licensed professionals and authorized transcriptionists. My Scribe Now is not a medical provider and does not diagnose or treat patients.
To use the Service, you must be at least 18 years old, a licensed medical professional or authorized scribe, and legally able to enter this Agreement. We may suspend or terminate access if you violate eligibility requirements or applicable laws.
Users must create accounts with accurate information, safeguard credentials, and promptly report any unauthorized access. You are responsible for all activity under your account. My Scribe Now is not liable for loss or damage caused by your failure to maintain account security.
By using the Service, you agree to use it only for lawful purposes, authenticate all transcriptions within three (3) business days as required by Oklahoma Administrative Code Title 310, and review them before inclusion in medical records. You must comply with HIPAA, state law, and professional standards.
My Scribe Now acts as a Business Associate under HIPAA. We safeguard PHI using encryption, access control, and audit trails. Users are responsible for lawful collection and handling that aligns with professional and legal requirements.
Users retain ownership of their recordings, transcriptions, and related data. My Scribe Now acts as a data processor only. We may use de-identified data for analytics and service improvement. Users grant us a limited license to process data solely to deliver the Service.
If applicable, users agree to pay fees as defined during registration or invoicing. Payments are non-refundable unless required by law. We may suspend access for non-payment and adjust pricing with notice.
Both parties must protect PHI and confidential data from unauthorized disclosure. Use of confidential information is limited to what is necessary for Service delivery. This obligation survives termination of your account.
All Service content, software, and branding belong to My Scribe Now or its licensors. Users receive a limited, non-exclusive right to use the Service. You may not copy, modify, reverse-engineer, or redistribute any part of it.
We may suspend or terminate Service if you violate these Terms, misuse PHI, or engage in fraudulent conduct. Upon termination, access credentials are revoked and retained data is deleted per our retention policy.
To the fullest extent allowed by law, My Scribe Now is not liable for indirect or consequential damages. Total liability shall not exceed fees paid in the past 12 months. We do not guarantee uninterrupted or error-free operation.
You agree to indemnify and hold harmless My Scribe Now, its affiliates, and staff from claims arising from misuse of PHI, violation of these Terms, or inaccuracies in transcriptions.
These Terms are governed by the laws of the State of Oklahoma. Disputes shall be resolved through binding arbitration in Tulsa County, Oklahoma, under AAA rules. You waive rights to class actions and jury trials.
The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for purpose, and non-infringement. We do not warrant transcription accuracy for clinical decision-making without physician review.
We may modify, suspend, or discontinue Service at any time without notice and are not liable for resulting impacts.
If any provision is found invalid, the remaining Terms remain enforceable.
These Terms, along with the Privacy Policy and any Business Associate Agreement, represent the entire agreement between you and My Scribe Now.
